EDMOND — Judge reschedules hearing for assault defendant

A preliminary hearing for a co-defendant in a domestic abuse case was rescheduled after he was late for a recent court date.

On Dec. 31, 2010, officers were dispatched to the 3000 block of Garden Vista, near Coltrane Road and Covell Road, in reference to a disturbance with an armed suspect, police said.

When the victim arrived at his home and walked through the door, the two suspects started punching him, police said. The victim said they were doing this because they felt the victim disrespected the homeowner by coming home late, police said.

Police said the victim was told to clean up blood, and while he was cleaning, the two men punched him in the face. The victim said the homeowner threatened him with a knife by saying he was going to “cut off one of his fingers,” police said.

Pedro Payan, 20, of Edmond, and Domingo Frias, 31, of Edmond, have been formally charged with assault and battery-domestic abuse resulting in great bodily injury.

Payan entered a plea of not guilty in court. He posted $8,000 bond in April, according to online court records. His preliminary hearing was scheduled for 9 a.m. Friday before Judge D. Fred Doak.

When Payan did not arrive on time, the hearing was rescheduled for Aug. 26.

The Oklahoma County Sheriff’s Office warrant team is looking for Frias. Anyone with information regarding the whereabouts of Frias are asked to call the Sheriff’s Office warrant hotline at 713-6262.

Judge sends high school beating defendant to trial

An 18-year-old student will stand trial on charges related to a February beating of a fellow student in a Memorial High School bathroom, a judge ruled.

Prosecutors allege that on Feb. 25, Shakil Fields, 18, of Arcadia, committed the felony crime of assault and battery with a dangerous weapon when he “willfully, knowingly and with the intent to do bodily harm, and without justifiable or excusable cause” hit and kicked the victim with his fists and shoes.

Fields’ next court date is a pretrial conference scheduled for Aug. 17 before Judge Jerry D. Bass. Fields has been charged with assault and battery with a dangerous weapon and assault and battery. He remains free on a $9,000 bond.

A motion by Fields’ attorney to dismiss due to insufficient evidence was overruled. Fields has entered a plea of not guilty.

The indictment states the defendant “was of robust health and strength,” and that he caused a fractured skull and hematoma to an “incapacitated person” who was “unable to defend himself.”

Just before noon on Feb. 25, School Resource Officer Bervis Littles was called to a boy’s restroom at Memorial High School, 1000 E. 15th St., where the victim was found lying on the restroom floor bleeding from the back of the head, Littles stated in an affidavit filed in Oklahoma County District Court.

The victim was transported to St. Anthony Hospital where he was treated for a skull fracture, jaw fracture, hematoma and a laceration to the back of the head, police said.

Witnesses said the defendant knocked the victim unconscious with his fists and then began kicking him in the head with his shoes, police said.
